NW Fencing Ltd Terms & Conditions
1.GENERAL
A. Unless otherwise agreed by NW Fencing Ltd in writing the below
Terms and Conditions shall apply to all goods and services made by NW Fencing Ltd to the exclusion of all other terms, conditions and warranties.
2.GUARANTEES
A. All work installed by NW Fencing Ltd is guaranteed. The installation guarantee is for 12 months from installation.
B. The buyer must retain their invoice as proof of purchase and guarantee.
C. Guarantee only covers against manufacturing & installation defects.
D. Recommended maintenance from the supplier of the materials must be adhered to.
E. In the event of a defect arising, which may be covered by this guarantee, full written details must be submitted to the company within seven days of the discovery of the alleged defect.
F. The person insured is the person named in the schedule and is none transferable.
Note: This guarantee is offered as an additional benefit by the company and in no way affects your statutory rights.
G: Force Majeure: A Force Majeure Event means any event beyond a party's reasonable control, which by its nature could not have been on foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own workforce or a third party's), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.
H. The company and its servents will do their upmost to keep any damage to a minimum but it can not guarentee to avoid damage to any products that are in the way of installation; we ask that all areas are covered or removed before work commences.
2.TIMBER & CONCRETE
A. Fence Panel Timber Knots & Feather Edge Boards: All timber fence panels will suffer from splits, cracks, shrinkage, expansion, twisting & warping and timber knots becoming loose and falling out. These issues are unavoidable with timber fence panels and as such are outside of our material defect guarantee. If you are not happy to have these naturally occurring issues present in your timber fence panel please choose an alternative material for your fence panel.
B.Timber Fence & Gate Posts: All timber fence & gate posts will suffer from splits, cracks, shrinkage, expansion, twisting & warping. These issues are unavoidable with timber posts and as such are outside of our material guarantee. If you are not happy to have these naturally occurring issues present in your timber fence or gate posts, please choose an alternative fence or gate post. We will not replace any timber fence or gate post which shows signs of any of these issues. NW Fencing Ltd offer concrete, metal, UPVC & composite fence & gate posts as an alternative.
C. Concrete fence posts may crack under working loads and are expected to crack at maximum working loads. Cracking of a post does not signify failure. The bar reinforcement is designed to control crack widths and withstand loads in excess of the maximum working load. In addition to wind loading, Class A posts are designed for handling, and if a crack appears in a post, this does not signify failure or reject. Crack widths up to 0.2mm do not have any significant effect on the durability resistance of the posts.
D.Concrete gravel boards do not provide any structural integrity beyond the downward force of the fence panel installed above the gravel board. NW Fencing Ltd does not provide any guarantee for concrete gravel boards used to retain soil or any other medium.
3.FENCE INSTALLATION
A. It is the responsibility of the buyer to ensure an individual is onsite or contactable for the duration of works who is capable of making any required decisions for work to be completed.
B. Once the buyer has decided how the fence to be fitted following
consultation with the fitting team, there may be additional charges
Ie. ‘Lay of the land’: most gardens have a slight fall. We always recommend to run with the fall of the land as this gives the strongest support. This can mean the panels are stepped. In some cases we can channel the fence line to go straight this is time consuming and must be discussed & priced accordingly.
C. Surrounding terrain: grass, flowers, plants etc. NW Fencing Ltd do not accept responsibility for any damage caused to the terrain required to stand on to install the fence. We have to stand on grass / garden where there is no path. Due to the weather, we work in wet conditions this can unturf the area on occasions. It is the buyers responsibility to remove any plants. NW Fencing Ltd do not work on boards unless supplied & liability insured by the buyer.
D. NW Fencing Ltd do not accept any liability on pipes or cables less than 21 inches below ground level. It is the I responsibility of the Buyer to inform NW Fencing Ltd Fencing of any
pipes or cables on the fencing line before
E.Height: Most garden boundary fences typically fall within 1 meter at the front and 2 meters at the back of the property. If the buyer requests a higher fence than recommended NW Fencing accept no liability. This will be stated on the invoice and a disclaimer will be issued to the buyer.
F.Structural integrity of Posts (concrete, wood, aluminium, UPVC, Composite)
NW Fencing Ltd offer no guarantee for the structural integrity of the fence post and concrete foundation installed by NW Fencing Ltd for long term stability of the fence post where the ground/site conditions are unsuitable for the fence post installation. Guarantee exclusions are detailed below:

Ground which has been previously excavated and backfilled, for what-ever purpose, and has not been adequately consolidated.

Ground which becomes waterlogged causing the ground condition to become soft and unstable allowing the fence post foundation to move within the soft ground.

Ground conditions which excessively dry out causing the ground to shrink back causing the concrete post foundation to become ‘loose’.

fence posts installed at a location which is expected to see maximum wind speeds in excess of 28m/s with a dynamic pressure resulting from the wind speed in excess of 0.5KN/m2. It is the responsibility of the purchaser to confirm these conditions
4.PRODUCT RANGE
A.Durapost: The DuraPost Guarantee gives you the peace of mind that the DuraPost fence post is guaranteed pop against structural failure due to corrosion for up to 25 years subject to normal maintenance and proper use.
*The length of the guarantee is dependent on whether the product has been powder-coated and the nature of the local environment.
Once we receive payment from you a receipt will be issued with a Durapost reference number, you will upload this and register with Durapost on their website and they will send you a confirmation email within 30 days.
B. Solidfence: Composite fencing products come with a 20-year manufacturing guarantee against rotting. Variations in colour, shade or pigment are NOT covered under our guarantee. These variations in no way affect the longevity of the product.
After installation:
During the extrusion process the recycled PVC granules are heated up to 195 lol degrees, the molten PVC is then fed into the tool to form the profile of the gravel board and post. Once out of the tool the gravel board and posts are immersed in water to cool the PVC down.
Guarantee terms and conditions:
The Company or seller offer a 20-year manufacturing guarantee against rotting. In the event of proven manufacturing defect, the Company or seller’s total liability shall under no circumstances exceed the price of the defective item. The company or seller shall not in any way be responsible for additional, consequential costs or losses. The company or seller accepts no responsibility for defects to products caused by
misuse or abuse. This guarantee does not cover any changes to the colour of the product due to natural weathering, shade.
After this process the profile retains some residual heat and when they are packed the residual heat can cause the boards and posts to sweat and this can cause a blotchy pattern. This is perfectly normal and after being in the sun and fresh air they will weather naturally. It is not a fault with the boards just a side effect of the manufacturing process
C. Other fencing ranges. All other fencing ranges supplied by NW Fencing Ltd come with manufacturer guarentee’s please ask for further details on where these can be found.
5.PAVING
1.Any defects in workmanship during the construction of the patio or similar domestic installation will be made good free of charge for a period of up to 1 year.
2.The company shall endeavour to make good any remedial works in a colour, pattern and finish as specified in the original contact; but no assurance can look be given that an exact recreation may be achieved as this depends upon the availability of materials and area size.
3. This guarantee covers the installation for reasonable domestic use, but does not extend to cover damage resulting from accident, misuse, neglect, lack of maintenance (including re-pointing if necessary) impact damage, commercial or industrial use, or staining caused by any substance whatsoever.
4. Settlement attributable to the construction of the works is covered but settlement attributable to construction of work not the responsibility of the company is not covered. Cover for any settlement in the ground at a level lower than that exposed during construction, resulting from, for example, the failure or collapse of any pre-existing installation, is excluded.
5. Movement, expansion or contraction or subsoil or base due to changes in temperature, water content and tree root activity are outside the control of the company and no guarantee can therefore be given should any damage occur due to these or related factors.
6.We do not cover manufacturing failures, this must be taken up with the manufacturer themselves following their T&C’s. please note: guarantees are for the structure and not the product, products would need to be taken up with the supplier. We will be happy to liaise with this.
7. In their early life products may appear to loose some intensity of colour or even experience a milky white stain on the surface. This may be attributable to a phenomenon known as efflorescence, which is of a temporary nature, and is not harmful to the performance of the paving. The installer cannot accept responsibility for the occurrence of this defect and the product will be covered under the terms of the supplier.
8. It is important for the paving to receive regular maintenance in accordance with the recommendations of the manufacturer of the product. The company will advise on the requirements, but if maintenance is neglected this will not become the liability of the company.
TITLE
A. Goods remain the property of NW Fencing Ltd until the contract value is paid in full.
B. If payment is overdue, the buyer gives NW Fencing the right to enter onto its property, or any other property where the goods are reasonably thought to be, for the purpose of recovering the property of NW Fencing Ltd. The Buyer will be responsible for all costs incurred by NW Fencing Ltd in recovering the goods.
